PUBLIC NOTICE

To the (your NH town) Chairman (his/her name) and the entire (your NH town) Board of Selectmen OR Town Council in New Hampshire: You are hereby Noticed.

I, (your name), am a Citizen of the State of New Hampshire, a qualified inhabitant, who is endowed with Rights secured by both the Constitution of New Hampshire and the Constitution for the United States of America.

A DECLARATION OF THE RIGHTS OF THE PEOPLE OF THE

STATE OF NEW HAMPSHIRE

“The whole and entire power of government of this State is vested in, and must be derived from, the people thereof, and from no other source whatsoever.”

NH STATE CONSTITUTION PART I

Part I, Bill of Rights, Article I;

“All men are born equally free and independent; Therefore, all government of right originates from the people, is founded in consent, and instituted for the general good.”

Part I, Bill of Rights, Article XII;

“Nor are the inhabitants of this State controllable by any other laws than those to which they, or their representative body have given their consent.”

As a citizen of NH, I do not consent to having my voter information be a part of a statewide election information portal.  Any act by the state government to include my voter information in a statewide election information portal would be an infringement on my protected 14th amendment of the Constitution for the United States of America rights.

The following Opinion was Issued on August 28, 2020 by the SUPREME COURT OF NEW HAMPSHIRE:

“Indeed, “[n]o branch of State government can lawfully perform any act which violates the State Constitution.” LaFrance, 124 N.H. at 176. Burt v. Speaker, N.H. House of Representatives, 2020

NH STATE CONSTITUTION PART II

Consider this communication to be a notice that any fiscal note originating in the senate that is relative to “the establishment of an election information portal and relative to the purchase of election equipment” shall be considered repugnant to the NH State Constitution Part II Form of Government;

Part II, Form of Government, Article XVIII;

“All money bills shall originate in the House of Representatives; but the Senate may propose, or concur with amendments, as on other bills.”

If the NH state legislature passes and the Governor approves a senate bill relative to “the establishment of an election information portal and relative to the purchase of election equipment”, without neither originating in the House nor the consent of the people of this State via an amendment to the NH State Constitution; the (your NH town) Board of Selectmen shall not consent with the acceptance of grant money to implement or enforce either an election information portal or the purchase of new election equipment.

Any compliance prior to a vote at a future (your NH town), NH Annual Town Meeting by a (your NH town)  Town official shall be considered repugnant and contrary to the NH State Constitution.

Any implementation or enforcement action of any kind by any “State,” “state,” or local actor shall be a violation of the 14th Amendment of the Constitution for the United States of America, and any such wrongdoer shall be liable to an action at law, suit in equity, or other proper proceeding for redress.

14th amendment

“Nor shall any State deprive any person of life, liberty, or property, without due process of law;”

Therefore, any encroachment of my aforesaid Constitutional Rights by any NH public official, shall subject the offender to a civil action in a Federal Court for deprivation of Rights. 

42 U.S. Code § 1983. Civil action for deprivation of rights;

Every person who, under color of any statute, ordinance, regulation, custom, or usage of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress.

And all public officials shall take notice to wit and conduct themselves accordingly.
