THE POWER POINT AND LETTER BELOW WERE SENT TO THE NH LEGISLATURES
New Hampshire Republican State Committee 13 October 2026
We have a vote counting crisis and someone has to step in to fix this.
Dear legislators-
We need your help now.
On 8 September 2026, during the primary, a Nashua Ward 9 moderator held a radio-frequency meter that
detects cellular, Wi-Fi, and radio activity beside an ImageCast voting machine. The radio number registered
activity. The electric and magnetic rows read zero so this was not detection of a motor. That is a meter record
of RF activity on the day of an election. It is not proof the machine was on the internet. No one can say it
was not. City and Concord officials were notified. Thirty-four days later, no office has contacted the moderator
or taken action. And once you read this letter, you will know the problem is much bigger.
The most basic level of security in New Hampshire law says a voting machine shall not have access to the
internet, and shall not be connected to it. RSA 656:42, X. It also states, if a part is altered, RSA 656:41
requires the Ballot Law Commission to approve the device again before it is used. We are heading into the
midterms and we can not confirm either of these things are true with 209 juristictions deployed and 96.5% of
all New Hamshire voters poised to cast their ballots in them.
Things roll down hill, and accelerate. This situation is no exception.
The Ballot Law Commission conditionally approved two voting machines in 2023: Liberty/Dominion ImageCast
and VotingWorks. They both introduced the QR code photo ballot counting technology into our elections
starting in 2023. The voter marks the oval. The camera photographs the ballot. The instructions on the scanner
tell the camera what picture to send. The computer turns that picture into the totals. The moderator signs the
tape. The path from ballot to the tape is sealed from any review. No one in any towns can read the election day
software. Incredibly, those pictures are not public ( RSA 656:42, IX). The approval did not include any
examination of a single machine delivered to our towns. The Election Assistance Commission chosen to do a
vendor sample lab test for NH doesn’t check these things either.
It gets worse: The ImageCast user manual describes a wireless modem and a port to be used to transmit
election results but does not limit its use. Do our machines have this? Any cellphone user can tell you that you
don’t need a port to send and receive data. Is there Internet access? Their software and memory card coding
is proprietary. No one can know what is does and no one has checked. VotingWorks named Custom America
in 2023 as its scanner in its approved proposal but now PageScan 6 is listed on their documents. Its parts list
says the computer board is made in Taiwan. No one knows what we have counting our ballots because no
one has checked. No test that counts ballot ovals is this check. No second scan by another unexamined
scanner is this check. Right now, this is all the state has offered,
This debacle now sits with the towns. The towns bought the Ballot Law Commission approved models. The
towns signed contracts with both vendors that have no scanner name, no modem finding, no materials list, no
internet statement, and no right for the town to open the unit and check. Towns are on the hook by law to
ensure their voting machine before any election is the approved model and cannot access the internet. A
contract does not repeal the law. The midterms are next.
The urgency to fix this is even higher with RF readings raising the very real possibility every town and city is
exposed. The Ballot Law Commission was noticed on 17 September. Every machine town was noticed on 23
September and again on 29 September. The Governor, the Attorney General, the Secretary of State, and both
election-law committees were noticed. No town has answered the 23 September notice.
We cannot accept silence. We are asking your help to prompt action from those who are responsible. We
want this fixed and the candidates do too. It would be a tragic outcome for New Hampshire who holds the
prestigious “First in the Nation” status to have its statewide elections disqualified because all those who should
have acted failed us.
